Es beantwortet diese Fragen, indem es sowohl die Kritiken am Universalismus als auch den Universalismus der Menschenrechte selbst auf die jeweiligen Formen und Effekte hin untersucht. Mit dem Postkolonialismus, dem Kulturrelativismus, dem Kollektivrecht sowie dem Feminismus werden vier prägnante Debatten um den Universalismus der Menschenrechte vorgestellt und mit nachvollziehbaren Beispielen in Verbindung gesetzt. Daraus entwickelt das Buch das Modell eines vermittelten Universalismus, der die Stärken der Kritiken aufnehmen und ihre jeweiligen Grenzen deutlich benennen kann.

Notions of public interests or common goods present a major reference point for the legitimation of global governance and global governors, yet they are rarely subject to closer analysis. After highlighting how a connection to public interests plays a shared pivotal role in legitimating public and private global governance actors alike, this article suggests an expanded understanding of public interests as consisting of a substantive element, an individual interest-based element, and a procedural element. This allows us to study how public interests are framed, affected, disputed, and shaped in global governance, and how global governors are (de)legitimized with certain notions of public interests. It sheds light on how individual interests form public interests (without reducing the former to the latter or vice versa), how apparently neutral, technocratic, or expert-driven ideas of public interests are a matter of (global) politics, and how all the elements of public interests are imbued with power inequalities. The expanded concept of public interests is based on an integration of the governance literature on input, throughput, and output legitimacy with moralist, empiricist, and procedural models from political philosophy. Ultimately, in explicating the often implicit yet formative notion of public interests in global governance, this article argues that the legitimation of global governors does not only depend on whether or not they cater to public interests. Rather, the question is how they frame and affect the substantive, individual interest-based, and procedural elements of public interests, thereby constructing publics in global politics.

International studies investigate the governance authority of state versus non-state actors in terms of their public or private authority. However, the public–private distinction does not sufficiently capture the variety of governance actors, or the forms of their authority, beyond that distinction. Focussing on businesses, this paper argues that certain governance actors assume public and private roles, as well as a third category of roles it calls 'societal' that transcend notions of public and private. To understand these roles and how they affect governance authority, this paper treats the public–private relationship as mediated and extends it with the 'societal' category, then translates it into the concept of business authority, which constitutes a particular form of governance authority alongside public and private authority. It does so by operationalising governance authority as a triadic concept composed of power, legitimacy and a connection to public interests. In all three components, business authority escapes the binary distinction between public and private without simply merging the two.

PurposeThis paper aims to introduce the extended qualitative content analysis (EQCA) method to integrate data-reducing and data-complicating research steps when conducting qualitative research on the United Nations and other international institutions.Design/methodology/approachEQCA supplements the method of qualitative content analysis, which enables researchers to deal with large amounts of data, with two elements from grounded theory, which allow detailed analysis and interpretation of codes and sub-codes. The elements in question are axial coding and theoretical sampling.FindingsEQCA provides a method to generate middle-range theories by combining theoretical and empirical analysis to address and theorize the complex interactions between actors, structures and norms in international institutions. The value added by the proposed method is demonstrated with a case study of a United Nations intergovernmental working group in the issue area of business and human rights.Originality/valueBased on the concepts of interpretation and social causality, this paper contributes to the body of qualitative research that transcends the dichotomy between positivist and post-positivist approaches in the disciplines of international relations and international political theory.

AbstractThe contestation of global governance institutions can strengthen or weaken, as well as transform, them. This article analyses the productive potential of contestation and justification of global governance institutions by examining the multiple authorities that are invoked as auxiliaries in the process. It studies the (re-)construction of these authorities by dissecting authority into three components: power, legitimacy and connection to public interests. Empirically, the article focuses on the issue area of business and human rights, examining the highly contested process of drafting a binding instrument in the United Nations Treaty Process. The analysis shows that the success of the Treaty Process not only hinges on its direct reaction to contestation, but also on its ability to (re-)construct the multiple related authorities. Ultimately, the article argues that the contestation of global governance institutions involves (re-)constructing multiple authorities. This demonstrates how contestation can also affect global governance institutions, actors and norms beyond the specific field of deliberation.
